Welcome to Lume Northam. By making a reservation, placing an order (where applicable), visiting our premises, using our website, or otherwise engaging with us, you agree to be bound by the following terms and conditions (“Terms”). If you do not agree, please do not proceed.

2. Reservations

- A reservation is not confirmed until you receive confirmation from us.
- Please arrive at your reservation time. If you are late, we may no longer be able to honour your table, especially if we are fully booked.
- Cancellation: if you wish to cancel or change your reservation, please inform us at least [Insert Time, e.g. 24 hours] in advance. If you do not cancel and do not show up (“no show”), we may charge a fee.
3. Menu, Pricing & Availability
- All prices are in Australian Dollars (AUD) and include GST unless otherwise stated.
- Prices and availability of menu items are subject to change without notice. Seasonal availability, supplier issues, or other factors may affect whether certain items are offered.
- While we strive to be accurate in menu descriptions (allergens, ingredients, etc.), substitutions or variations may occur.
4. Food Safety & Allergies
- Please inform staff of any dietary restrictions, allergies, or special requirements when you make your reservation or when you arrive.
- While we take care to avoid cross-contamination, we cannot guarantee that any dish is entirely free of allergens.
5. Conduct & Use of Premises
- You agree to behave in a respectful and lawful manner while on our premises. We reserve the right to refuse service or ask any person to leave if their conduct is inappropriate, unsafe, or disruptive.
- Smoking, vaping or illicit drug use is not permitted on our premises.
6. Website & Online Ordering / Services
- You must be at least 18 years old to use our website or place any orders (if applicable).
- We try to ensure our website is accurate, up-to-date, and free of viruses or other harmful content. However, we do not guarantee that the website will always be available, error-free or secure.
- Any online payment details are handled securely. However, we are not responsible for issues beyond our control, such as your device’s security or third-party payment processors, to the extent permitted by law.

- We collect, use and store your personal information in accordance with our Privacy Policy. By using our website or booking/reserving with us, you consent to that policy.
8. Liability & Disclaimers
- To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages resulting from your use of our website or services, or from visiting our premises.
- Our liability for any claim arising out of or related to these Terms is limited to the amount you paid (if any) for the service or reservation in question.
- Nothing in these Terms excludes, restricts or modifies your rights under Australian Consumer Law (ACL) which cannot be excluded.
9. Intellectual Property
- All content on the website (text, images, logos, menus, design) is owned by us or our licensors. You may view or download content for your own non-commercial use, but you must not reproduce, distribute, modify or commercially exploit it without our written consent.
10. Cancellation / Changes By Restaurant
- We reserve the right to cancel or modify reservations, specials or events (for example, due to staff unavailability, emergencies, or other circumstances beyond our control). We will give you as much notice as possible.
- If we cancel a reservation, we will not impose any cancellation fee, and we may offer an alternative date where possible.
11. Gift Vouchers / Promotions
- If gift vouchers or promotional offers are issued, they are subject to specific terms (validity periods, redemption conditions, non-transferability etc.).
- Promotions cannot normally be combined unless stated.
12. Force Majeure
- We are not liable or responsible for any failure to perform, or delay in performance of any of our obligations under these Terms if such failure or delay is caused by any event beyond our reasonable control (including but not limited to natural disasters, supply chain disruptions, government orders, etc.).
13. Changes to Terms
- We may update or change these Terms from time to time. When we do, we will post the updated Terms on our website, with the “Last updated” date revised. Continued use of our website, making a reservation, or dining at Lume Northam after changes constitutes your acceptance of the revised Terms.
14. Governing Law
- These Terms are governed by the laws of Western Australia and Australia. Any disputes will be subject to the non-exclusive jurisdiction of the courts in Western Australia.
